It is a bit too much strict, maybe as bad as the one of C$: The creator/owner of this profile (presented by real name or nickname) grants you a limited license to access and make personal use of this profile and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of the owner. This should be add "or for personal use". Otherwise would not even allow to make a printout to be taken when vising the person. This license does not include any resale or commercial use of this page or its contents; any collection and use of any listings, descriptions, or pictures; any derivative use of this page or its contents; any downloading or copying of account information for the benefit of merchants; or any use of data mining, robots, or similar data gathering and extraction tools. This page or any portion of this page (including the associated photo pages) may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of the creator/owner. You may not frame or utilize framing techniques to enclose any proprietary information (including images, text, or page layout) of the creator/profile owner without express written consent. This one would be implicit given the previuous paragraph. You may not use any meta tags or any other "hidden text" utilizing the profile owner's name or quotes without the express written consent of the creator/owner of this profile. Any unauthorized use terminates the permission or license granted by the creator/owner. Who is the people that wrote this ... a lawyer of a patent troll company? why could not use as a meta tag in a page someone owner name (think about someone that as a common word as name ...) You are granted a limited, revocable, and nonexclusive right to create a hyperlink to this page (for the purpose of creating a friendship or written reference) from your profile so long as the link does not portray the creator/owner or its couchsurf experiences in a false, misleading, derogatory, or otherwise offensive matter. Who decide if it is derogatory ? This would forbide to leave negative references, even if motivated ! You may not use any personal, private information or other proprietary graphic without express written permission. Again pleonastic. ...; from the pan to the fire ... Leo, you seem to misinterpret the meaning of the word "derogatory". How would you define a reference of the kind "not recommendable guest, always late, come home drunk and screaming in the night awaked neighbours, left stinky clothes in a common area annoying other guests, after his leave after staying two night i never found again the spare towels i leave for guests." ? That reference sounds factual (based on a description of an experience, and a recommendation). Since I wasn't there I can't tell if it is an accurate description. It is unpleasant for the recipient. Can we please keep this thread on the topic of terms of use? This is not a real reference, but one that could fall within the term "derogatory" althought being still factual ... Think about another "he stinks, has an ugly voice, he broke half the things he used, was unpleasant with the other guests" ... Leo, It may be an interesting exercise to evaluate the Terms created by our fellow CS activist. Their conception is not to exploit fellow CS members, but rather to confront CS management head-on, playing largely the same game as CS. Thereby revealing its ridiculousness. But also confronting CS with unilateral Terms which are potentially just as valid as theirs from a legal standpoint. Written together with a lawyer, these member Terms are not designed to do harm to anyone, and will not do any harm to anyone. With the potential exception of the CS "owners" of your private data attempting to exploit us all, first by criminal theft, and now by criminal fencing. David |
